סעיף 1 - תנאי שימוש בחנות המקוונת

סעיף 2 - תנאים כלליים

אנו שומרים לעצמנו את הזכות לסרב לספק שירות לכל אדם, מכל סיבה שהיא ובכל עת. הנך מבין/ה שהתוכן שלך (למעט פרטי כרטיס אשראי) עשוי לעבור ללא הצפנה, וכי הדבר כרוך ב-(א) העברות דרך רשתות שונות; וכן (ב) שינויים להתאמה לדרישות הטכניות של הרשתות או המכשירים המחוברים. פרטי כרטיס אשראי מוצפנים תמיד בעת ההעברה ברשת. הנך מסכים/ה שלא לשכפל, להעתיק, למכור, למכור מחדש או לנצל כל חלק מהשירות, שימוש בשירות, או גישה לשירות, ללא אישור מפורש בכתב מאיתנו. הכותרות בהסכם זה נועדו לנוחות בלבד ואינן משפיעות על התקנון.

סעיף 3 - דיוק, שלמות ועדכניות המידע

הנך מסכים/ה לספק מידע רכישה וחשבון עדכני, שלם ומדויק לכל הרכישות המתבצעות בחנות שלנו. הנך מסכים/ה לעדכן באופן מיידי את חשבונך ומידע נוסף, לרבות כתובת הדוא"ל שלך, כך שנוכל להשלים את העסקאות שלך וליצור עמך קשר לפי הצורך.

סעיף 7 - כלים אופציונליים

סעיף 10 - מידע אישי

סעיף 11 - שגיאות, אי-דיוקים והשמטות

סעיף 12 - שימושים אסורים

בנוסף לאיסורים אחרים המפורטים בתקנון זה, אסור לך להשתמש באתר או בתוכנו: (א) למטרה בלתי חוקית; (ב) לשדל אחרים לבצע מעשים בלתי חוקיים; (ג) להפר כל תקנה, חוק או תקנון מקומי, ארצי או בינלאומי; (ד) להפר את זכויות הקניין הרוחני שלנו או של אחרים; (ה) להטריד, להעליב, לפגוע, להשמיץ, לבזות, להפחיד או להפלות על בסיס מגדר, נטייה מינית, דת, מוצא אתני, גזע, גיל, מוצא לאומי או מוגבלות; (ו) למסור מידע כוזב או מטעה; (ז) להעלות או לשדר וירוסים או קוד זדוני אחר; (ח) לאסוף או לעקוב אחר מידע אישי של אחרים; (ט) לבצע ספאם, פישינג או "גירוד" מידע; (י) למטרה תועבתית או בלתי מוסרית; או (יא) להפריע לתכונות האבטחה של השירות. אנו שומרים לעצמנו את הזכות להפסיק את השימוש שלך בשירות בגין הפרת כל אחד מהשימושים האסורים.

סעיף 13 - כתב ויתור על אחריות; הגבלת אחריות

המוצרים המוצעים באתר נמכרים כפי שהם ("as is"), למעט אחריות מפורשת הניתנת על ידי היצרן, ככל שקיימת, ולמעט כל זכות שאינה ניתנת להתניה לפי חוק הגנת הצרכן, התשמ"א-1981, או כל דין מגן צרכני אחר.

תיאורי המוצרים, התמונות והמידע הנלווה המוצגים באתר נועדו למטרות מידע כללי בלבד, ואינם מהווים חוות דעת מקצועית, המלצה מחייבת או התחייבות לתוצאה מסוימת. האחריות על אופן השימוש במוצר על ידי הלקוח חלה על הלקוח בלבד, בכפוף להנחיות היצרן המצורפות למוצר (ככל שישנן) ולכל דין.

החברה אינה אחראית לכל נזק עקיף, תוצאתי, מקרי או מיוחד שייגרם כתוצאה משימוש במוצר או בשירות, לרבות אך לא רק אובדן רווח, אובדן שימוש או נזק לרכוש אחר, למעט במקרה של רשלנות רבתי או זדון מצד החברה.

אחריותה הכוללת של החברה כלפי הלקוח בכל הקשור למוצר מסוים לא תעלה, בכל מקרה, על הסכום ששולם בפועל בעד אותו מוצר.

אין באמור בסעיף זה כדי לגרוע מזכויות הצרכן הקוגנטיות (שאינן ניתנות להתניה) הקבועות בחוק הגנת הצרכן, התשמ"א-1981, או בכל דין אחר.

סעיף 14 - שיפוי

הנך מסכים/ה לשפות ולהגן על Tula ועל החברות האם, החברות הבנות, השותפים, נושאי המשרה, הדירקטורים, הסוכנים, הקבלנים, המתמחים והעובדים שלנו, מפני כל תביעה או דרישה, לרבות שכר טרחת עורך דין סביר, שהוגשה על ידי צד שלישי כלשהו כתוצאה מהפרתך את תקנון זה או כל דין או זכות של צד שלישי.

סעיף 15 - הפרדה

במקרה שייקבע כי הוראה כלשהי בתקנון זה אינה חוקית, בטלה או בלתי ניתנת לאכיפה, הוראה זו תיאכף במידה המרבית המותרת על פי הדין החל, וחלקה הבלתי ניתן לאכיפה ייחשב כמופרד מתקנון זה, מבלי להשפיע על תוקפן ותחולתן של יתר ההוראות.

סעיף 16 - סיום

התחייבויות וחבויות הצדדים שנוצרו לפני מועד הסיום יישארו בתוקף לאחר סיום הסכם זה, לכל מטרה. תקנון זה יעמוד בתוקף אלא אם ועד אשר יבוטל על ידך או על ידינו. הנך רשאי/ת לבטל תקנון זה בכל עת על ידי הודעה לנו כי אינך מעוניין/ת עוד בשימוש בשירותים שלנו. אם לפי שיקול דעתנו הבלעדי נגלה שהפרת הוראה כלשהי מתקנון זה, אנו רשאים לסיים הסכם זה בכל עת ללא הודעה מוקדמת, ותישאר/י אחראי/ת לכל הסכומים המגיעים עד למועד הסיום, ו/או נהיה רשאים למנוע ממך גישה לשירותים שלנו.

סעיף 17 - ההסכם המלא

אי-מימוש או אכיפה של זכות או הוראה כלשהי מתקנון זה על ידינו לא יהווה ויתור על זכות או הוראה זו. תקנון זה וכל מדיניות או כללי הפעלה שפורסמו על ידינו באתר מהווים את ההסכם וההבנה המלאים בינך לבינינו, וגוברים על כל הסכמים, תקשורות והצעות קודמים, בין בעל פה ובין בכתב, בינך לבינינו.

סעיף 18 - דין חל

תקנון זה וכל הסכם נפרד שבמסגרתו אנו מספקים לך שירותים יהיו כפופים לדיני מדינת ישראל ויפורשו בהתאם להם.

סעיף 19 - שינויים בתקנון

ניתן לעיין בגרסה העדכנית ביותר של התקנון בכל עת בעמוד זה. אנו שומרים לעצמנו את הזכות, על פי שיקול דעתנו הבלעדי, לעדכן, לשנות או להחליף כל חלק מתקנון זה על ידי פרסום עדכונים ושינויים באתר. באחריותך לבדוק את האתר מעת לעת לאיתור שינויים. המשך השימוש באתר או בשירות לאחר פרסום שינויים לתקנון זה מהווה הסכמה לשינויים אלה.
